This electronic record is generated by a computer system and does not require any physical or digital signatures.
Use of the website is available only to such people who can legally contract under Indian Contract Act, 1872. People who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 shall not be eligible to use the website.
Any minor desirous to use or transact on the website, is required to conduct such transactions through their legal guardian or parents.
The Website reserves the right to terminate any membership and refuse to provide access to the Website if it is brought to the Website’s notice or discovered that the person accessing/using the Website is under the age of 12 years.
The Cubber Services are not available to persons under the age of 12 or to anyone previously suspended or removed by cubber wallet from availing the cubber Services or accessing the cubber Platform.
By accepting the T&Cs or by otherwise using the Cubber Services on the Cubber Platform, You represent that You are at least 12 years of age and have not been previously suspended or removed by Cubber, or disqualified for any other reason, from availing the Cubber Services or using the Cubber Platform.
In addition, You represent and warrant that You have the right, authority and capacity to enter into this Agreement and to abide by all the T&Cs as part of this Agreement.
Finally, You shall not impersonate any person or entity, or falsely state or otherwise misrepresent Your identity, age or affiliation with any person or entity. in the event of any violation of the T&Cs, Cubber reserves the right to suspend or permanently prevent You from availing Cubber Services or using the Cubber Platform.
We only ask the product not being used and preserve its original condition, tags, and packaging. You are welcome to try on a product but please take adequate measures to preserve its condition. There is one way to return the product:
Self-Ship: Cubber will check and send you a form if product matches the criteria of return policy. We will credit the shipping cost in that form. You have to share the scan copy of the courier receipt to us after processing the return.
We will then initiate a doorstep refund for the return amount being selected for refund mode while initiating the return request.
Cubber application can be used for day to day activities like recharge and bill payment for mobiles, DTH, electricity, gas, landline, broadband, data card, insurance and water bill where refund is not possible.
Cubber wallet is there only for customer to add money and make transaction easily through it by means of doing any kind of payment through cubber application.
Any kind of booking service such as bus, event, amusement, flight, and hotels are not refundable.
When you use the website or send emails or other data, information or communication with us, you agree and understand that you are communicating with us through electronic records. You consent to receive communications via electronic records from us periodically, as and when required. We may communicate with you by email/mobile number or by such other mode of communication, electronic or otherwise.
Cubber will make best efforts to provide alerts via SMS/e-mail/push notifications and it shall be deemed that customer have received the information sent from Cubber as an alert on the mobile phone number or e-mail ID provided during the course of, or in relation to, using the Cubber platform or availing any Cubber services.
Cubber shall not be under any obligation to confirm the authenticity of the person(s) receiving the alert. You cannot hold Cubber liable for non-availability of the SMS/email alert/push notifications service in any condition whatsoever.
All transactions on the Cubber application, monetary and otherwise, are non-refundable, non-exchangeable and non-reversible, except in the event of proven gross negligence on the part of Cubber or its representatives, in which event the user agrees that the user shall only be entitled to a refund of the amount actually paid by the user and actually received by Cubber with respect to the recharge done by the user.
This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Cubber has been advised of the possibility of such damage. Because some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, Cubber liability in such jurisdictions shall be limited to the extent of the amount actually paid for by any user while availing any of the services on the Cubber website.
If any dispute, controversy or claim arises under this agreement or in relation to any Cubber services, including any question regarding the existence, validity or termination of this agreement or T&Cs (hereinafter Dispute), the parties shall use all reasonable endeavors to resolve such Dispute amicably.
If the parties are unable to resolve the Dispute amicably within 30 days of the notice of such Dispute, Cubber may elect to resolve any Dispute by a binding arbitration in accordance with the provisions of the Indian Arbitration & Conciliation Act, 1996 (hereinafter Act).
Such Dispute shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The Dispute shall be resolved by a sole arbitrator, appointed in accordance with the Act.
The seat of the arbitration shall be New Delhi and the language of this arbitration shall be English. Either you or Cubber may seek any interim or preliminary relief from a court of competent jurisdiction in New Delhi necessary to protect the rights or the property belonging to you or any of our agents, suppliers, and subcontractors, pending the completion of arbitration.
Any arbitration shall be confidential, and neither You nor Cubber may disclose the existence, content or results of any arbitration, except as may be required by law or for purposes of enforcing the arbitration award.
All administrative fees and expenses of arbitration will be divided equally between You and Cubber. In all arbitrations, each party will bear the expense of its own lawyers and preparation. This paragraph shall survive termination of this Agreement.
We may share some or all of the information you provide with the Payment System Providers, Card Associations, Issuing Banks, Partner Bank, Nodal Banks, Merchants/Billers and other statutory, regulatory and governmental authorities.
By accepting these Terms and Conditions, you authorize Cubber to request for supplemental documentation at any time (before or after your Cubber Account has been activated), in order to verify your identity and the accuracy of the information provided.
If we cannot verify that this information is accurate and complete, we may deny your use of the services, or close your Cubber account at any time. At any time, Cubber and/or the Payment System Providers may conclude that you cannot be permitted to use the services.
As part of the Cubber registration process, you will create a username and password for your Cubber Account. You must choose a reasonably descriptive username that clearly identifies you or your business.
In addition, your password should not contain any details about you that is easily available or identifiable. You are responsible for maintaining the confidentiality of the password and the Cubber Account.
For security purposes, we recommended that you memorize your password and do not write it down. You agree not to disclose these credentials to any third party. Any person to whom you give your password will have full access to your payment information, and you assume all risk of loss resulting from any such access.
All information and instructions received from your Cubber Account will be deemed to have been authorized by you and the recipients of this information shall rely on its authenticity based on the use of your password. You will be responsible for all actions taken by anyone accessing the services using your username and password.
In the event of any dispute between two or more parties as to ownership of a particular Cubber Account, you agree that Cubber will be the sole arbiter of such dispute. Cubber's decision (which may include termination or suspension of any account subject to dispute) will be final and binding on all parties.
By submitting information, data, passwords, user names, other log-in information, materials and other content to us, you are granting us the right to use that for the purpose of providing services.
By using the services, you expressly authorize Cubber to access your account information and payment information and submit the same further for processing your payments to any party to whom it is required to be submitted for the purpose of providing you services.
We shall be acting as an intermediary, while providing you payment facilitation services. You agree that our role is limited to facilitating your payment instructions and providing other value added services.
Apart from e-KYC based access, users agree to comply with requirements and avail limited wallet access by sharing their minimum details. Cubber accepts user's self-declared name, officially valid document including Aadhaar number and mobile number verified with OTP as minimum details required as per RBI guidelines, as amended from time to time.
You are solely responsible for any unauthorized access to your personal or financial information that result from your failure to properly follow the security procedure detailed in these Terms and Conditions. Cubber will not be liable for any loss, damage or other liability arising from your failure to comply with the terms and conditions herein or from any unauthorized access of your Cubber account. We will also have no liability and you agree to assume all risk of loss that arises out of or relates to any loss or theft of your device or any information contained within any device.
The use of a device such as mobiles, tablets and laptops involves risks as also does the usage of internet. For example, sensitive personal information or financial data that is transmitted from or to a device or internet may be intercepted and used by third parties without your knowledge.
Viruses, spyware and other “malicious code” can also be downloaded to your devices without your knowledge. By using a device and internet to access the Sites, you assume all of those risks and agree that we will have no liability whatsoever to you for any loss or theft (including identity theft) occurring as a result of such risks.
Data transferred via the sites is encrypted in an effort to provide transmission security. Notwithstanding our efforts to ensure that the sites are secure, you acknowledge that mobile transmissions and the Internet are inherently insecure and that all data transfers, occur openly and potentially can be monitored and read by others. We cannot and do not warrant that all data transfers utilizing our sites will not be monitored or read by others.
Cubber facilitates the payment of certain bills through the Cubber Platform with respect to certain services offered by Cubber business partners who have partnered with Cubber to enable their bills to be paid through the Cubber Platform.
Please see the relevant links on the Cubber platform for more information on Cubber’s bill payment service. Further, Cubber also offers certain digital products which facilitate the purchase of prepaid recharges for mobile, DTH, toll and data card as well as purchase of movie tickets, bus tickets, hotel reservations, flight tickets and purchase of tickets to amusement or theme parks.
Other digital products available on the Cubber Platform also include coupon redemption services. The terms and conditions in relation to bill payments and digital products are set out below.
The terms and conditions in relation to bill payments and digital products set out below are applicable to and binding on you in conjunction with the SSOID terms and conditions already accepted by you. Each SSOID term or condition is applicable to and binding on you, or any of your activities on the Cubber Platform, even if such term or condition is not specifically reproduced herein below.
The terms ‘Agreement’ or ‘T&Cs’ mentioned herein below includes the terms and conditions in relation to bill payments and digital products set out below and the SSOID terms and conditions as well as other service-specific terms and conditions in relation to Cubber Services or Cubber Platform.
An unauthorized transaction occurs when a payment is made from your account that you did not authorize. For example, if someone makes a transaction from your account using a stolen password, an unauthorized transaction has occurred. If you provide access to your account to a third party (by disclosing your login or/and BHIM UPI PIN or MPIN information or any other information) and they conduct transactions without your knowledge or permission, you are responsible for any resultant use. The liability of any misuse is solely Yours, until you report the issue to Cubber .
